Description: The Arizona Department of Transportation (ADOT) pays in-lieu fees for certain 404 permit mitigations. ADOT coordinates with the Arizona Game and Fish Department (AGFD) to determine appropriate mitigation strategies when ADOT construction projects remove either riparian habitat or adjoining uplands and habitat associated with intermittent water supplies. ADOT, AGFD and the Corps of Engineers—whose Section 404 requirements frequently originate the search for mitigation—have agreed that ADOT’s mitigation investment to repair degraded habitats can sometimes be utilized more constructively away from the highway than on-site. Consequently, ADOT, AGFD, and the Corps designed a system to focus mitigation resources where they will produce the greatest benefit for the ecosystem.

When deciding to use in-lieu fees, the ADOT, with assistance from AGFD, looks for areas where important restoration needs have been identified. ADOT and AGFD also identify groups that are trying to protect, conserve or enhance habitat within the vicinity of, and within the same watershed as, the project area. If an off-site location for mitigation can be found where the benefits to the overall habitat are greater than would be achieved at the project location, ADOT pursues in-lieu fee mitigation. Consequently, in-lieu fees are supporting a variety of restoration efforts throughout the state, including work along the Verde River to enhance Southwestern Willow Flycatcher habitat and restoration of the upland, riparian, and dry wash areas of the McDowell Sonoran Preserve.
