INDOT’s Cultural Resource Manual was published in 2007 and provides guidance to the Indiana Department of Transportation (INDOT), Local Public Agencies (LPAs), and their consultants on how the FHWA Indiana Division will accomplish its responsibilities under the revised Section 106 Regulations (36 CFR 800, effective January 11, 2001) regarding the preservation and protection of historic properties. An update to the manual is anticipated in 2014.

The procedures (Chapter 3 of the Cultural Resources Manual) authorize INDOT and LPAs to initiate Section 106 consultation on behalf of FHWA for projects listed in the INDOT Statewide Project Monitoring System. Required Section 106 documentation can be incorporated into a project's Environmental Impact Statement, streamlining the NEPA process. In addition, the procedures address concerns related to the role of consultants and assure government-to-government contact with Native American Tribes. Per a request by the Advisory Council on Historic Preservation, FHWA incorporated several Section 106 consultation meetings into the procedures to ensure that all consulting parties become involved early and comment on documents and decisions.

The Cultural Resources Manual incorporates the Programmatic Agreement (PA) Among the Federal Highway Administration, the Indiana Department of Transportation, the Advisory Council on Historic Preservation and the Indiana State Historic Preservation Officer Regarding the Implementation of the Federal Aid Highway Program in the State of Indiana (also known as the “Minor Projects PA”), which was finalized in October 2006. This allows INDOT to independently perform the work and consultation described in the following sections of 36 CFR Part 800 (including any succeeding revisions to the regulations) on behalf of FHWA as follows:

(4) Results of assessment

If INDOT determines, in consultation with the SHPO and consulting parties, that the project will have an adverse effect on historic properties, it will notify FHWA and FHWA will ensure the Section 106 process is completed. FHWA will continue to be responsible for making a finding of “adverse effect” and for the resolution of those effects. The minor projects PA also developed a list of undertakings that consist of minor projects that generally do not affect historic properties. This listing falls into two categories, minor projects that do not require review by INDOT Cultural Resources staff, and minor projects that do require documentation and review by INDOT Cultural Resources staff to assess the likelihood that historic properties exist in the area of potential effect or determine the degree of existing soil disturbance within the project area.

In recognition of the unique government-to-government relationship between the Federal government and Indian tribes, FHWA shall take the lead in identifying and establishing consultation with the Indian tribes and Tribal Historic Preservation Officers (THPO) consistent with 36 CFR § 800.2(c)(2). If the tribe is agreeable, further consultation may be conducted among the tribe and INDOT. Delegation of Section 106 authority to the state allows state agencies to become more involved in the protection of local historic resources. The delegation also allows FHWA to focus its involvement at strategic points where it can best manage the process.
