Description: The Texas Department of Transportation (TxDOT) helped the U.S. Fish and Wildlife Service (USFWS) realize the long-term conservation objectives of the Balcones Canyonland Wildlife Refuge, home to a large number of threatened and endangered species. In the process, TxDOT satisfied federal Endangered Species Act Section 7 consultation requirements for the Golden-cheeked warbler in a streamlined fashion by purchasing 153 acres of banked credits at $5,000/acre, to compensate for projected impacts to the warbler. The credits are offered by the owners of a large family ranch near the Balcones Canyonlands, in the priority acquisition area of the wildlife refuge.

The purchase is included as a condition of the biological opinion issued by the U.S. Fish and Wildlife Service (USFWS) for the Texas Turnpike Authority’s US 183A project. In turn the Hickory Pass Ranch Conservation Bank has an agreement with the USFWS to preserve and protect habitat for the Golden-cheeked warbler, and to sell mitigation credits in acre units to compensate for the effects of proposed projects on the species.

The agreement is designed to benefit other species as well and for the land to be managed for the species in perpetuity. The USFWS-approved conservation bank covers the 3,000-acre ranch, and requires the ranch owner and credit seller to develop an annual management plan and submit it to USFWS. USFWS holds the right to appoint another conservation entity as the manager and transfer the million-dollar endowment. As part of the conservation bank agreement, USFWS reviews the five-year management plan and the status of the endowment on an annual basis. TxDOT investment in the habitat conservation bank streamlines the consultation and regulatory approval process while contributing to the achievement of ecoregional and national conservation priorities.
