Section 4(f) Process: Image Description

The flowchart starts in the top center with this rectangle: “Identify any parks, recreation areas, wildlife and waterfowl refuges, or historic sites that would be used by the project.” There are three arrows from this rectangle.

1. If there are none of the things listed, follow the middle arrow straight down to this rectangle: “Document in project file. End.”

2. If there are one or more historic sites, follow the second arrow to the left and down to this rectangle: “Coordinate with SHPO/THPO to determine if site is eligible. Public or private ownership is irrelavent.” An arrow points from this rectangle down to this rectangle: “Is the site on or eligible for the National Register of Historic Places?” If the answer is “No,” follow the arrow to the right to this rectangle: “Document in project file. End.” If the answer is “Yes,&rdquo follow the arrow down and to the right to this rectangle: “Is the impact found to be de minimis (23 CFR 774.3(b), 5(b), & 7(b)) or covered by a programmatic evaluation (23 CFR 774.3(d))?”

3. If there are park/recreational area(s) and/or wildlife/waterfowl refuge(s), follow the third arrow to the right and down to this rectangle: “Identify and consult with the official(s) with jurisdiction (23 CFR 774.17).” Follow the arrow from this rectangle down to this rectangle: “Is area publicly owned and accessible, functioning as a 4(f) property and considered significant?” If the answer to this question is “No,” follow the arrow to the left to the rectangle: “Doucument in project file. End.” If the answer is “Yes,” follow the arrow down and to the left to the rectangle: “Is the impact found to be de minimis (23 CFR 774.3(b), 5(b), & 7(b)) or covered by a programmatic evaluation (23 CFR 774.3(d))?”

At the rectangle with this question - “Is the impact found to be de minimis (23 CFR 774.3(b), 5(b), & 7(b)) or covered by a programmatic evaluation (23 CFR 774.3(d))?” - if the answer is “Yes,” follow the arrow up to the rectangle “Document in project file. End.” If the answer is “No,” follow the arrow down to this rectangle: “Prepare individual evaluation (23 CFR 774.3(a), 5(a), 7 & 9).” Follow the arrow from this rectangle down to this rectangle: “Is there a prudent and feasible avoidance alternative (23 CFR 774.17)?” If the answer is “Yes,” follow the arrow to the left to the rectangle: “Select this alternative. End.” If the answer is “No,” follow the arrow down to this rectangle: “If more than one alternative, select the alternative with the least overall harm (23 CFR 774.3(c)). Document all possible planning to minimize harm (23 CFR 774.17). End.”
